Judge Lewis Kaplan has ordered a trial for Virginia Giuffra’s allegations that the Duke of York abused her when she was trafficked by pedophile financier Jeffrey Epstein.

Prince Andrew is said to be “not surprised” by the verdict against him, but says it will be a “marathon and not a sprint”.

Judge Lewis Kaplan has ordered a trial for Virginia Giuffra’s allegations that the Duke of York abused her when she was trafficked by pedophile financier Jeffrey Epstein.

Andrew’s legal team argued that the case should be dismissed as it denies all allegations against him.

Epstein and Ghislaine Maxwell, who were convicted of child trafficking last month, forced the 17-year-old into sex with Andrew at the time, Ms Giuffre claims.

A source close to the duke said: “Given the determination with which Judge Kaplan welcomed our arguments, we are not surprised by the verdict.

“However, this was not a judgment on the merits of Mrs Giuffre’s allegations. It is a marathon and not a sprint and the Duke will continue to defend himself against these allegations.”

It comes when Prince Andrew has been stripped of all his military titles and royal patronage by the Queen, and as a true royal source, he will never return to official duties.

The embarrassed Duke of York will no longer be able to reach his royal highness, as he will disappear from public life forever after a judge decides he will have to face a civil trial on charges of sexual abuse.

A Buckingham Palace spokesman said: “With the Queen’s permission and consent, military relations and the King’s patrons of the Duke of York have been returned to the Queen.

“The Duke of York will continue to perform no public duties and is defending this case as a private citizen.
A royal source said: “All the duke’s roles have been returned to the queen with immediate effect to distribute it to other members of the royal family – they will not return to the duke of York.

“The Duke of York will no longer use the style of ‘His Royal Highness’ in any official role.”

U.S. District Judge Lewis Kaplan made his decision after a videoconference hearing with representatives of the Queen’s son. The prince was not present.

Describing his reasons for rejecting the Duke of York’s motion to dismiss the civil case against him, the judge said the agreement in the civil settlement between Epstein and Mrs Giuffre “cannot say” that it would benefit him.

In his decision, he said: “The 2009 agreement cannot be said to clearly and unequivocally prove that the parties intended to benefit the instrument‘ directly ’,‘ primarily ’or‘ substantially ’from Prince Andrew.

“The existence of the intended intent to benefit him or others comparable to them is a factual issue that could not be properly decided on this proposal, even if the accused belonged to a language of release that is inherently ambiguous.

“Thus, whether or not the release statement refers to Prince Andrew, the agreement is at least ‘reasonably receptive to more than one interpretation’ on the equally important question of whether this defendant can rely on it.”

The Duke’s relationship with his former billionaire friend Epstein dates back to 1999, when Maxwell is said to have introduced him to him.

Andrew has been Maxwell’s friend since her time at Oxford University.

The kingdom flew with Epstein on its private plane in February 1999, when it was supposed to travel to the financier’s private island of Little St James in the US Virgin Islands.

The Kingdom invited both Epstein and Maxwell to the Queen of Decades event at Windsor Castle in June 2000.
