Fox News is facing an investigation into allegations it withheld evidence in a defamation case brought by Dominion Voting Systems.
A Delaware judge said he would impose sanctions against the media giant after accusing its lawyers of failing to be “candid” with him.
a fox is accused of defaming the Dominionvoting technology company by linking it to unproven allegations of fraud during the 2022 presidential election.
claims, which has fueled a range of conspiracy theories and Donald Trump’s allegations that Joe Biden stole the election were rejected by more than 50 judges.
Fox claimed it was merely reporting on newsworthy allegations made by the former president and his legal team.
Dominion complained that Fox’s legal team did not promptly turn over evidence.
The trial itself, in which Dominion is seeking $1.6bn (£1.3bn) in damages, is due to start on Monday, with jury selection set to begin on Thursday.
According to Dominion, the delayed evidence included tapes of some of its content, including Maria Bartiroma, one of its hosts, talking to two members of Trump’s legal team, Sidney Powell and Rudy Giuliani.
Dominion’s attorney said it was still receiving documents from Fox in the days leading up to the trial.
“We are constantly learning more important information from individuals other than Fox,” said Davida Brook.
“And to be honest, we don’t really know what to do about it.”
Another email sent to Dominion recently was from Ms Powell to Ms Bartiromo, who relayed evidence from a woman who claimed to have discovered the fraud because of her special powers, including the ability to travel through time.
